1. About these Terms

PixelPict is a pixel-art color-by-number game operated by Anh Tu Do, an independent developer based in Texas, United States ("the developer," "I," or "me"). Questions can be sent to doanhtu07@gmail.com.

These Terms govern use of PixelPict and its related services. Please read them before using the game. If you do not agree, do not use PixelPict. Applicable app-store agreements also apply.

The Privacy Policy explains data handling. Accepting these Terms is not consent to optional advertising tracking or other processing that requires separate consent.

2. Eligibility and accounts

PixelPict is intended for people 13 and older, not for children under 13. If you are below the age of legal majority where you live, a parent or guardian must review and agree to these Terms on your behalf where required. Local laws may impose additional age or consent requirements.

You can play as a guest without creating a PixelPict account. Optional Apple, Google, or Facebook sign-in enables account features such as cloud progress sync. Keep access to your sign-in provider secure and contact support if you believe your PixelPict account has been compromised. PixelPict never needs your sign-in provider's password.

Guest progress stays on the device. Signing out can clear local progress, including changes not yet synced. Cloud sync depends on connectivity and service availability; it is not a guarantee against all data loss.

3. License and acceptable use

Subject to applicable store rules and these Terms, you may use PixelPict and its included artwork and audio for your personal, noncommercial enjoyment. The app and its content are licensed, not sold. Rights in software, artwork, audio, branding, and other content remain with the developer or their respective owners and licensors.

Do not unlawfully copy or resell the app or its content, interfere with the service, access another person's data, bypass payment or security controls, or use the service fraudulently. Restrictions do not override rights that applicable law or an applicable open-source or content license gives you.

Coloring an included artwork does not transfer ownership of its underlying intellectual property. These Terms do not claim ownership of your personal information or require a broad marketing license to your private coloring progress. Any third-party notices or attribution requirements remain applicable.

4. Free play, ads, and hints

The current free game makes its artwork catalog available without picture purchases. It can show interstitial ads at gameplay breaks and offers user-initiated rewarded ads to unlock a color's highlight in an artwork. A rewarded hint is granted after the app receives the qualifying reward event; dismissing an ad early or an ad failing may not grant a hint.

Saved hint unlocks can be lost when their associated local or account data is deleted. Ad availability varies by location, connectivity, consent, and provider availability. Declining tracking is not a reason to block ordinary gameplay. An ad linking to a third-party service does not mean the developer endorses that service.

5. PixelPict Plus

PixelPict Plus is a one-time, non-consumable purchase, not a recurring subscription. It removes mid-progress and finished-art interstitials and provides unlimited hints without rewarded ads. It does not transfer ownership of the artwork or promise that third-party SDKs stop all processing; see the Privacy Policy.

The standard U.S. price is US$9.99. The actual localized price, applicable taxes, and purchase conditions displayed by Apple or Google at checkout control your purchase. Prices for future purchases may change without charging existing buyers again for the same purchased upgrade.

"Lifetime" means the upgrade does not have a scheduled subscription expiry or recurring fee. It does not mean a promise to operate the game, cloud services, or every future product forever. This explanation does not permit the developer to arbitrarily withdraw paid benefits or exclude mandatory consumer remedies.

Purchases are processed by Apple or Google, with RevenueCat used to validate purchases and manage access. Use Restore purchase in the Plus screen to restore an eligible purchase using the appropriate store account. Account-based access depends on sign-in, product availability, and store rules. A purchase is not a guarantee of restoration through a different app store.

Family Sharing is not enabled for Plus. A purchase does not grant separate family members their own Plus entitlement through Family Sharing. Applicable store usage rules still apply.

Deleting a PixelPict account does not refund or cancel a store purchase. Restoring a valid purchase after deletion may recreate a purchase-management record. A store refund, revocation, or failed verification can remove access to Plus, subject to applicable law and store rules.

6. Refunds and consumer rights

For purchases made through the App Store, see Apple's refund process. For Google Play purchases, see Google Play's refund process. You may also contact PixelPict support for help with purchase issues.

Refund eligibility is governed by the relevant store rules and applicable law. Nothing in these Terms excludes mandatory refund, withdrawal, warranty, or other consumer rights.

7. Account and data deletion

You can delete your account through the app or submit an external request as explained on the account-deletion page. Deletion removes the active account and associated synced progress; the associated RevenueCat customer is also submitted for deletion. Apple and Google retain their own store purchase records.

A minimal deletion marker containing internal account identifiers and deletion-related timestamps is retained temporarily to make repeated deletion requests safe and block stale writes from restoring progress. It becomes eligible for hourly, batched cleanup 24 hours after the progress purge, once the account is confirmed deleted. Pending deletions retain the marker until they can be completed. The Privacy Policy explains the timing and other retention exceptions. Deletion is not a promise to erase all records held independently by third parties.

8. Availability, changes, and suspension

PixelPict may need maintenance, updates, or changes to support security, reliability, platform requirements, and new features. The developer cannot guarantee uninterrupted access or that cloud sync will always succeed. Where changes materially affect paid benefits or legal rights, appropriate notice and any legally required remedies will be provided.

Access may be restricted where reasonably necessary to address a material breach of these Terms, fraud, threats to security, or legal obligations. Where reasonable and lawful, the developer will explain the restriction and provide an opportunity to resolve it. Contact support if you believe a restriction is mistaken.

9. Disclaimers and responsibility

PixelPict is entertainment, not medical advice or a treatment for a health condition. General descriptions of relaxation do not promise a therapeutic result.

To the extent permitted by law, the service is provided "as is" and "as available," without promises beyond those expressly made or required by law. The developer is not responsible for losses that were not reasonably foreseeable or are caused by circumstances outside the developer's reasonable control, to the extent such a limitation is lawful.

Nothing in these Terms excludes liability that cannot legally be excluded, including for fraud, intentional misconduct, or other protected claims. Mandatory consumer warranties and remedies remain available.

10. Applicable law and resolving concerns

Please contact doanhtu07@gmail.com first so the developer can try to resolve a concern informally. This is not a condition that prevents you from exercising a legal right or meeting a legal deadline.

Texas law governs these Terms to the extent permitted by applicable law, excluding its conflict-of-laws rules. This choice does not take away mandatory protections of the law where you live, or any right to bring a claim in a court available to you under applicable law. It does not override Apple's or Google's separate agreements.

11. App stores and third-party services

Apple, Google, sign-in providers, and other third-party services have their own terms. For iOS distribution, Apple's Standard End User License Agreement applies unless a valid custom EULA is provided through the appropriate Apple process. These Terms are not intended to replace that Standard EULA or conflict with mandatory store terms. The developer, not Apple or Google, provides PixelPict support.

12. Updates and contact

The date above identifies the latest version of these Terms. Material changes will receive appropriate notice and renewed acceptance where required. Changes do not retroactively remove accrued consumer rights. If a provision is unenforceable, the remainder applies to the extent lawful.
